5. Our legal bases for processing
Depending on the circumstances, we may rely on one or more of the following legal bases.
Legitimate interests
We may process personal information where necessary for our legitimate interests in operating a recruitment business, identifying suitable candidates, providing recruitment services, communicating with candidates and clients and developing our business, provided that those interests are not overridden by your rights and freedoms.
For example, we may identify or contact you where your professional experience indicates that you could reasonably be interested in a relevant career opportunity.
Consent
We may rely on your consent where appropriate.
Where processing is based on consent, you may withdraw your consent at any time. Withdrawal will not affect the lawfulness of processing carried out before your consent was withdrawn.
Contract
We may process information where necessary to take steps at your request before entering into a contract or to perform our contractual obligations.
Legal obligations
We may process or retain information where necessary to comply with applicable legal, regulatory, tax, accounting or other obligations.
6. Candidate sourcing
Recruitment frequently involves identifying individuals who have not applied directly to Mana Talent.
We may therefore process limited professional information obtained from publicly available or professional sources where we reasonably believe that your background may be relevant to a recruitment opportunity.
This may include information such as your name, current employer, job title, location, professional experience, skills and publicly available professional profile.
Where appropriate, we may contact you to determine whether you are interested in discussing a particular opportunity.
You have the right to object to this processing at any time.
7. Sharing your information
We do not sell your personal information.
Where necessary and appropriate, personal information may be shared with:
-
prospective employers after the relevant opportunity has been discussed and agreed with you;
-
clients engaging Mana Talent to provide recruitment services;
-
recruitment technology and applicant tracking system providers;
-
IT, hosting, cloud storage and communications providers;
-
scheduling and productivity service providers;
-
professional networking and recruitment platforms;
-
professional advisers, including accountants and legal advisers;
-
regulators, courts, public authorities or law enforcement where required by law; and
-
another party where you have specifically authorised us to share the information.
Where service providers process personal information on our behalf, appropriate contractual and data protection safeguards will be used where required.
8. Recruitment technology and Manatal
Mana Talent uses Manatal as an applicant tracking and recruitment management system.
Candidate information may be stored and processed within Manatal for purposes including managing candidate records, recruitment opportunities, applications, communications and recruitment processes.
We may also use professional networking, sourcing, communications, productivity and other business technologies where reasonably necessary to provide our recruitment services.
Technology may assist with research, organisation, drafting, candidate matching or other recruitment-related activities. However, recruitment decisions and candidate assessments involve human judgement.
Mana Talent does not make solely automated decisions about candidates that produce legal or similarly significant effects.
9. How long we keep candidate information
Mana Talent generally retains candidate information for up to five years from our last meaningful interaction with you.
We use this retention period because a candidate’s professional experience and relationship with Mana Talent may remain relevant to future recruitment opportunities over several years.
A meaningful interaction may include, for example:
-
communication regarding a potential role;
-
receiving an updated CV or professional information;
-
participation in a recruitment process;
-
an interview or recruitment discussion; or
-
another substantive recruitment-related interaction.
We periodically review the information we hold and may delete or anonymise information that is no longer relevant, accurate or necessary for our recruitment activities.
Information may be retained for longer where necessary to comply with a legal obligation or to establish, exercise or defend legal claims.
You may request deletion of your personal information at any time. Where there is no overriding lawful reason requiring us to retain it, we will delete or anonymise the relevant information.
10. Other business records
Personal information relating to clients, suppliers and other business contacts will be retained for as long as reasonably necessary for the relevant business relationship and thereafter where necessary to meet legal, tax, accounting, contractual or regulatory requirements.
11. International transfers
Some technology and service providers used by Mana Talent may process or store personal information outside Ireland or the European Economic Area (“EEA”).
Where personal information is transferred outside the EEA, we will take appropriate steps to ensure that the transfer complies with applicable data protection legislation.
Depending on the destination and provider, these safeguards may include a European Commission adequacy decision, Standard Contractual Clauses or another legally recognised transfer mechanism.
12. Your data protection rights
Subject to applicable law and certain exceptions, you may have the right to:
-
request access to the personal information we hold about you;
-
request correction of inaccurate or incomplete information;
-
request deletion of your personal information;
-
request restriction of processing;
-
object to processing based on legitimate interests;
-
object to direct marketing;
-
request portability of certain personal information;
-
withdraw consent where we rely on consent; and
-
lodge a complaint with the relevant supervisory authority.
To exercise any of these rights, please contact Mana Talent using the contact details provided at the end of this Privacy Notice.
We may need to verify your identity before completing certain requests.
13. Complaints
If you have concerns about how we process your personal information, we encourage you to contact us first so that we can try to resolve the matter.
You also have the right to lodge a complaint with the Data Protection Commission (DPC), the supervisory authority for data protection in Ireland.
Further information is available from the Data Protection Commission at www.dataprotection.ie.

Our website may use cookies and similar technologies required for its basic operation, functionality and security.
Third-party functionality integrated into our website, such as scheduling services, may also process information when you interact with those services.
We may introduce analytics services, including Google Analytics, to help us understand how visitors use our website and improve our services.

Where applicable, you will be able to manage or withdraw your cookie preferences.
Further information about the cookies and technologies used on our website may be provided through a separate Cookie Policy and/or cookie consent tool.
15. Scheduling services
Our website may allow you to schedule a meeting or call using a third-party scheduling service.
When you choose to use such a service, information such as your name, email address, selected meeting time and any information you voluntarily provide may be processed for the purpose of arranging and managing the meeting.
The relevant scheduling provider may also process information in accordance with its own privacy practices.
16. Third-party websites and services
Our website may contain links to third-party websites or services, including professional networking platforms, recruitment systems, scheduling services and other external websites.
These third parties operate independently and may have their own privacy notices and practices. We encourage you to review those notices when interacting with their services.
17. Security
We take appropriate technical and organisational measures designed to protect personal information against accidental or unlawful destruction, loss, alteration, unauthorised disclosure or access.
Access to candidate and business information is limited to those who require it for legitimate business purposes.
However, no method of electronic transmission or storage can be guaranteed to be completely secure.
18. Changes to this Privacy Notice
We may update this Privacy Notice from time to time to reflect changes to our recruitment activities, technology, service providers or legal obligations.
